What is IPTU

IPTU (Imposto Predial e Territorial Urbano) is the annual municipal property tax assessed on urban real estate in Brazil. It is paid to the municipal prefecture and funds local government services. IPTU is entirely distinct from ITBI, which is the one-time transfer tax triggered by sale — buyers frequently confuse the two, but they serve different legal purposes and payment timelines.
Annual property tax
Outstanding IPTU from prior years can encumber the property and, depending on contract terms and municipal enforcement, create buyer liability if not cleared before transfer. Due diligence always includes IPTU clearance certificates, and purchase contracts should require the seller to settle arrears as a condition precedent to escritura pública execution.
Arrears before transfer
After acquisition, the new owner receives IPTU bills and must pay annually to avoid fines, interest, and judicial collection that can ultimately affect the property's marketability.
