What are condominium fees and why do they matter

Condominium fees (taxa de condomínio) are monthly charges paid by apartment and gated community owners to fund building maintenance, staff, security, shared amenities, reserve funds, and association administration under Brazil's Condominium Law (Law 4.591/1964). Associations possess significant legal powers to collect arrears, impose fines, restrict unit access, and initiate judicial collection against delinquent owners.

What fees cover

Seller arrears create buyer exposure if not identified and cleared before transfer. A unit with unpaid condominium fees may carry debt that survives closing or triggers association objection to registry recording. Due diligence includes a condominium clearance certificate (certidão negativa or equivalent), and purchase contracts should require the seller to settle outstanding balances as a condition precedent to escritura pública.

After purchase, timely payment protects ownership rights and preserves good standing with the association — particularly important for foreign owners who rely on property managers and cannot personally monitor building administration or general assembly decisions affecting their unit.
